Terms of Service
Effective Date: October 26, 2025
These Terms govern all services provided by Pool Armor Pros throughout Southwest Florida, including pool care, pressure washing, soft washing, paver services, and sanitation services.
1) Acceptance of Terms
By requesting a quote, scheduling a service, submitting a referral, or using our website, you agree to these Terms of Service (“Terms”). If you accept on behalf of a property owner, HOA, manager, tenant, or business, you represent and warrant that you are authorized to do so.
2) Services We Provide
Pool Armor Pros provides residential and commercial services in Southwest Florida, including but not limited to:
- Weekly pool cleaning, chemical balancing, equipment checks, and related maintenance
- Green-to-clean recovery, algae treatment packages, stain treatment, and drain/refill services
- Storm and hurricane clean-outs
- Pressure washing (driveways, lanai pavers, sidewalks, curbs, common areas, commercial corridors)
- Soft washing (house washing, vinyl/wood fence washing, soffits, fascia, exterior structures)
- Paver cleaning, polymeric sand re-sanding, and paver sealing
- Trash can sanitation (one-time or recurring)
- Other services as described in a written, texted, or emailed quote

3) Quotes, Pricing & Changes
- Inspection Required: Quotes and estimates are based on the information you provide and remain subject to onsite inspection. Pricing may be adjusted if conditions differ from what was described or reasonably expected.
- Scope Changes: Additional charges may apply for excessive algae, debris, staining, calcium/scale, rust, oil, irrigation stains, maggots/infestations in trash cans, or other conditions requiring extra labor, chemicals, or visits.
- Market Changes: We may adjust pricing with reasonable notice to reflect changes in chemical costs, fuel, labor, disposal fees, or other operating costs.
- Water Usage: All services may require the use of your on-site water supply (including but not limited to pool service, pressure washing, soft washing, paver work, and trash can sanitation). Customer-provided water usage is part of the service and is not reimbursed.
- Commercial Work: Larger or commercial properties may incur trip charges, extended labor rates, or after-hours fees as agreed in the quote.
4) Scheduling, Access & Safety
- Service Routes: Weekly pool service is completed on an assigned route day. Weather, traffic, emergencies, and holidays may affect time of day or, in rare cases, shift the day.
- Access: You agree to provide safe access to all work areas, including gates, yards, equipment pads, and trash bins. Pets must be secured. If we are unable to access the property or work area, the visit may be forfeited or billed as a trip charge at our discretion.
- Turned-Off Equipment: If pumps, breakers, automation, or other equipment are turned off by the customer, a third party, or the utility provider, we cannot guarantee water clarity, sanitation, or circulation outcomes.
5) Pool Water Level, Equipment & Customer Responsibilities
- Water Level: You are responsible for maintaining proper pool water level. Low water can cause pump cavitation, air in lines, equipment damage, or an inability to service the pool properly.
- Customer Maintenance: Failure to maintain timers, baskets, valves, automation settings, or circulation as recommended may result in cloudy water, algae growth, staining, or other issues, for which we are not liable.
- Equipment Failure: We are not responsible for damage caused by failed, aging, or defective pumps, filters, heaters, salt cells, automation, leaks, or plumbing.
- Pre-Existing Conditions: We are not liable for pre-existing issues such as cracked plaster, delamination, rust spots, calcium/scale build-up, embedded black algae roots, stains, degraded paver joints, failing coatings, or unstable surfaces.
- Water & Utilities Provided by Customer: You agree to provide on-site water and standard utilities (including hose bibs/spigots and electrical outlets where available) for Pool Armor Pros to perform pool service, pressure washing, soft washing, paver cleaning/re-sanding/sealing, and trash can sanitation. We do not supply water. All water usage associated with the service is your responsibility and will not be reimbursed.
6) Pressure Washing & Soft Washing (Summary)
By scheduling pressure or soft washing (including house washing and fence washing), you acknowledge that different surfaces react differently based on age, porosity, exposure, previous coatings, and maintenance history. Oxidation removal, discoloration, lightening, or streaking may occur and is not considered damage. 7) Paver Cleaning, Re-Sanding & Sealing (Summary)
Pavers are natural and manufactured materials subject to efflorescence, color variation, and weathering. Sealing may darken color or change appearance. Polymeric sand and sealer performance are affected by weather and prior products. A full Paver Cleaning, Re-Sanding & Sealing Disclaimer is posted separately and incorporated into these Terms.
8) Trash Can Sanitation (Summary)
Deep, long-term odors and staining in trash bins may not fully resolve after cleaning. A dedicated Trash Can Sanitation Disclaimer is posted separately and incorporated into these Terms.
9) Chemicals & Water Chemistry
- You authorize us to use pool chemicals reasonably necessary to sanitize, balance, and protect the pool and equipment.
- Weather, rain, heat, sunlight, landscape debris, and bather load all affect chemical demand and clarity.
- Green-to-clean and algae treatments may require multiple visits, filtration adjustments, brushing, vacuuming, and filter cleanings (additional fees may apply).
10) Photos, Records & Marketing
We may document conditions before, during, and after service (including photos or videos) for internal records, quality control, and training. Non-identifying images may be used in marketing materials unless you opt out in writing. We will not publish your address or personally identifying information alongside such images.
11) Payments, Billing & Deposit Terms
- Weekly Pool Service: Billed for the current month on the 1st of each month, in advance. If you sign up mid-month, your first invoice is prorated from the start date through the end of that month and is billed on the day you complete the ACH/credit card autopay form.
- Algae Treatments / Green-to-Clean: Billed at 100% of the quoted amount on the same day you are hired for that service (or on the day of service, as specified on your invoice). No 50/50 split applies.
- Storm & Hurricane Clean-Outs: Billed at 100% of the quoted amount on the same day you are hired for that service (or on the day of service, as specified on your invoice).
- Exterior “CSS” Services (Clean / Softwash / Seal): For pressure washing, soft washing (including house and fence washing), paver cleaning, re-sanding, paver sealing, and similar exterior surface services, payment is 50% non-refundable deposit upfront and 50% due upon substantial completion on the same day the work is performed, unless otherwise stated in writing.
- Methods of Payment: We accept card, ACH, or other approved methods through secure third-party payment processors. You agree that charges may be processed automatically for recurring services under your autopay authorization.
- Late or Returned Payments: Past-due balances may incur a late charge up to the lesser of 1.5% per month or the maximum allowed under Florida law. Returned or declined payments may incur a processing fee.
- No Refunds on Services Rendered: Services and chemicals already provided are not refundable.
12) Cancellations & Rescheduling
- Weekly Pool Service: You may cancel ongoing weekly service with at least 7 days’ notice so that routes can be adjusted. Any balances for services already performed remain due.
- One-Time & CSS Jobs: Deposits for scheduled pressure washing, soft washing, paver work, and similar jobs may be applied to rescheduling at our discretion if notice is provided, but are generally non-refundable once we have reserved your date and mobilized for the job.
- Access Issues: If we cannot access your pool or work area due to locked gates, vehicles, unsafe conditions, or other customer-controlled obstacles, the visit may be forfeited or billed as a trip charge.
13) Storms, Hurricanes & Force Majeure
Florida storms, hurricanes, flooding, road closures, and other events outside our reasonable control may delay or suspend service. We resume normal operations as soon as safely possible. Post-storm clean-outs and extra recovery work are separate billable services.
14) Communications & Marketing Consent (TCPA)
By providing your phone number or email, you consent to receive calls, texts, and emails regarding scheduling, service updates, billing, and promotions. Message/data rates may apply. You may opt out of promotional texts at any time by replying STOP. We may still send transactional or service-related messages as allowed by law.
15) Privacy & Data (Florida)
We safeguard personal information consistent with our Privacy Policy and applicable Florida law, including the Florida Information Protection Act (FIPA) regarding breach notification. Please refer to our separate Privacy Policy for details on data collection, use, and your rights.
16) Warranty & Disclaimers
- We provide services in a professional and workmanlike manner consistent with reasonable industry practices for residential and light commercial service providers.
- We do not warrant or guarantee the performance or lifespan of equipment, manufactured products, surfaces, sealers, coatings, or materials supplied by third parties.
- Disclaimer: Except as expressly stated in these Terms, all services are provided “as is” and “as available,” without any other warranties (express or implied), to the fullest extent permitted by law.
17) Limitation of Liability
- To the fullest extent permitted by Florida law, our total aggregate liability for any claim arising out of or relating to our services is limited to the amount you paid for the specific service giving rise to that claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost use, loss of enjoyment, lost rents, or business interruption.
- We are not liable for conditions caused by improper customer maintenance, low water level, failure to run equipment as instructed, landscaping debris, pre-existing defects, or factors outside our reasonable control.
18) Indemnification
You agree to indemnify, defend, and hold harmless Pool Armor Pros and its owners, employees, and subcontractors from any claims, damages, or losses arising out of your breach of these Terms, your misuse of the services, or unsafe/hazardous conditions you control at the service location.
19) Collections, Attorney’s Fees & Liens (Florida)
- Pool-Related Services: Unpaid balances for pool service, algae treatments, and storm clean-outs may be referred to collections, reported to credit bureaus where applicable, or pursued in small-claims or county court as allowed by Florida law. You agree to pay reasonable collection costs, court costs, and attorney’s fees incurred in recovering past-due amounts, to the extent permitted by law.
- Exterior “CSS” Work and Property Improvements: For exterior cleaning, soft washing, paver cleaning, re-sanding, sealing, and similar property-improvement work, we reserve the right to seek all remedies available under Florida law, which may include recording a lien or construction-related lien where legally applicable under the Florida Construction Lien Law and related statutes, after providing any notices required by law.
- Cooperation: You agree to promptly address and resolve any unpaid balances and communicate with us in good faith to avoid escalation.
20) Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue for any dispute shall lie in the state courts having jurisdiction over the county where the serviced property is located (for example, Lee, Charlotte, Collier, or Sarasota County), and the parties waive any objection to personal jurisdiction or venue in those courts.
21) Changes to These Terms
We may update these Terms from time to time. The Effective Date at the top reflects the current version. Continued use of our website or services after updates constitutes your acceptance of the revised Terms.
